  • Eligible New Zealand citizen: or
  • Your spouse or relationship can be the same or different sex

You will need to apply for a Partner Provisional Visa – Subclass 309, this visa lets you quickly enter and live in Australia temporarily, and then you can continue to apply for permanent residency via Partner Migrant Visa – Subclass 100.

Partner Provisional Visa – Subclass 309

  • This is a temporary visa and you must be outside Australia when you apply
  • The processing time for this visa is from 16 to 22 months

  • If you are not married but in a relationship (de facto) with your partner, your relationship must be at least 12 months before you apply for this visa

Partner Migrant Visa – Subclass 100

  • This visa is for permanent residency
  • You have applied for Partner Provisional Visa-Subclass 309 for at least two years
  • Your Partner Provisional Visa-Subclass 309 is granted
  • The processing time for this visa from 12 to 24 months
  • You must continue the relationship with your partner whilst your application processes

If You are currently in Australia (onshore):

  • If you are in Australia and are the husband, or wife of, or in a relationship (Your spouse or relationship can be the same or different sex (de facto) with:
  • an Australian citizen; or
  • Australian permanent resident; or
  • Eligible New Zealand citizen; or

You can apply for a Temporary Partner Visa – Subclass 820 (TR), this visa lets you continue to live in Australia temporarily, and then you can continue to apply for permanent residency via the Permanent Partner Visa Subclass 801 (PR).

 Temporary Partner Visa – Subclass 820 (TR)

  • This visa is for temporary residency
  • You must be in Australia when you apply
  • Processing time for this visa is from 19 to 24 months
  • Government cost from $7,715 Aud
  • If you are not married but in a genuine relationship (de facto) with your partner, your relationship must be at least 12 months in duration before you apply for this visa

After two years since you applied for 820 Visa and it has been granted. You are then eligible to apply for a Permanent Partner Visa – Subclass 801 (PR) to get permanent residence

Partner Visa Permanent – Subclass 801 (PR)

  • This visa is for permanent residency 
  • Processing time for this visa from 7 to 17 months
  • Government cost from $7,715 Aud
  • You must hold a Partner Visa Temporary -Subclass 820
  • Your relationship must continue with your partner during your application processing

For Fiancee – You have not married but you intend to get married in Australia:

If you intend to get married with an Australian citizen or permanent resident, or an eligible New Zealand citizen, and you are living in another country than Australia, you can apply for a Prospective Marriage Visa – Subclass 300. This visa allows you to quickly enter and temporarily live in Australia and to get married with your spouse.

Prospective Marriage Visa – Subclass 300

  • The processing time of this visa is from 16 to 18 months
  • Government cost from $7,715 Aud
  • You are allowed to stay in Australia for up to 9 months
  • After the visa is granted, you must enter and register your marriage in Australia within 9 months since your visa was granted.

After you get married to your spouse in Australia and you wish to live in Australia permanently, you can follow the steps above to apply for Partner Visa Temporary-Subclass 820 (TR) and then Partner Visa Permanent- Subclass 801 (PR).
